weak root systems. >> dan: that is what we can expect. thanks so much. in east palo alto, folks are mopping up from a flood tonight. while engineers try to prevent another one. the creek jumped its bank and levee last night. heather ishimaru is live with a look at the emergency work being done there right now. >> reporter: dan, we are on east bayshore above the creek. at this time last night was on its way up these banks getting ready to rise above the banks and cross over to 101. we have just learned that the california conservation corps is coming to help the city of east palo alto with sandbagging and repairs to this levee that sort of compromised last night and was leaking, what they call a boil was created. they are hoping to take advantage of the dry weather in advance of the storms expected tomorrow. >> they spent the morning power washing his muddy backyard. it's feet from the creek which last night rose at least 15 feet to spill over its banks and into his backyard. >> every year, every year. because like i say, it could happen. >> primary challenge has been funding. >> rep

chances. >> dan: better safe than sorry. there are flooding concerns in sonoma county where several roads and streets are still closed. reporter cornell bernard is live in napa. a dramatic water rescue on napa river. >> much of wine country is still drying out after the storm, but the napa river as you can see here is still high, swollen with rain. we arrived moments after a man wound up in the river right underneath the third street bridge. >> a man flailing, fighting to stay afloat in the middle of the napa river. crowds on the bank watched the drama unfold. >> they were there really quick. >> we needed to get him out real quick. we got a good throw on the rope. >> the victim was pulled ashore. a ladder was brought in and the man was pulled to safety. there was no time to waste. in sonoma county, high water is still a big issue. intersection of 12 and 121 was underwater when sonoma creek overflowed its banks. today the water is still spilling into nearby vineyards. >> it looks like the ocean is out there right now. only nice thing is all the vines are dormant so there is no harm. >> doz

evening hours. >> dan: we'll see you again shortly. getting to our reporters. sergio quintana is live in the santa cruz mountains with the story there. >> reporter: it started raining here in the last hour and a half or so but the last few days the series of storms has really left santa cruz mountain community very rain soaked. there are some residents who were bracing for tonight's line of rain. >> drivers who were either on that way to holiday dinner or leaving festivities had to deal with rain soaked roads. storms over last few days have left hillsides saturated like this one near boulder creek. they have been quick to cordon them off to make for safer driving and with today's line of rain storms, some residents took a break from the usual christmas tradition to load up on sandbags in ben lomond. even a little more rain could mean trouble. >> big concern why you are filling up on sandbags? >> to keep the hill from sliding into my neighbor's house. i have water running off from the top of my driveway. >> they are not threatening to overflow banks even with today's rain. there i

evening. merry christmas, i'm dan ashley. this christmas day we are on storm watch. we have live team coverage with reporters in key trouble spots in the north bay and santa cruz mountains. let's begin with spencer christian tracking the storm. >> quite a storm it's been already. here is how it looks at the moment. the rainfall, showers possible and thunderstorm or two just off the north coast. heaviest rainfall throughout the day mainly in the north bay but it's tapering off whether where there are some breaks where they are getting the steadier rainfall right now. through san francisco across the bay to the east bay. areas of light to moderate to alamo and concord. it's in the south bay to santa cruz and gilroy and points southward down to the salinas valley where we have the most widespread rain at the moment. it's not over yet. we've had batches and periods of heavy wind and rain and there some more on the way. it will be a wet and soggy nights. seven-day forecast and close up looks at the locations where we x-some heavy rain during the evening hours. >> dan: we'll see you ag

much - until now. dan deming of stutland equities joins us this morning for chart talk. hi dan. what's happening with the vix? > > hey chuck. you are certainly seeing some strength there, some concerns as we roll toward the end of the year with no deal out of washington. you are seeing some vol buyers enter the market on a daily basis now. even though we have seen the market down the last five days after reaching a peak in the s&p of 1447. it is not down significantly, yet we are still seeing pretty active vol buyers, and you are seeing the vix up around that 19.5 level - it has not been there since july of this year. > we also had a quadruple witching day which has now passed. i expect that probably factored in a little bit. but do you expect less volatility now? > > actually it is hard to say. i think there are still going to be concerns as we roll in toward the beginning of the year. if there is no deal, i think you are going to continue to see vol buyers into january, because the expectations are the s&p could slip significantly if nothing gets done. we are trending right now back

that chevron 'has' obtained those permits. kron 4's dan kerman joins us now.with details. dan - that rebuilding plan generated quite a bit of controversy? >> reporter: it did catherine. it was all about the type of pipe that would be used to replace the one that ruptured. the concern here is what would be best to prevent corosion which is believed to be the cause of august's pipe failure. chevron proposed using a 9- percent chromium steel pipe. but the chemical safety board questioned why they were not using stainless steel with 18% chromium..which they believed was the industry standard. the city hired outside experts who ultimately concluded 9 chrome provides an "inherently safer design" with that the city of richmond went ahead and issued permits for the repair of crude unit 4. the chemical safety board said "we will not endorse or object to that decision" city councilman tom butt said he believes chevron "covered all their bases" and says ultimately no pipe will last forever which is why they must be "rigorously inspected on a regular basis." and catherine chevron says it is plea
